Terms of Service

1. Eligibility and customer responsibilities

You must be at least 18 years old and able to enter into a binding agreement. You agree to provide accurate, current information and to keep your account credentials secure. You are responsible for activity performed through your account unless you promptly notify us of unauthorized access.

2. Booking and service confirmation

A booking request is not a confirmed reservation. A service becomes confirmed only after it has been accepted through the booking process and any required customer confirmation or payment authorization has been completed. Availability, providers, schedules, and prices may change before confirmation.

The confirmed booking details identify the service, provider, dates or times, pets, price, and any applicable additions or special arrangements. Please review those details promptly and report errors before service begins.

3. Prices and payment

Prices and estimated charges are shown during the booking process. You authorize us and our payment processor to charge the payment method associated with your booking for confirmed services, approved changes, cancellation charges, and other amounts you expressly authorize or that are disclosed in the applicable booking terms.

Estimates may change if you request additional time, pets, services, dates, or other modifications. Any material change will be communicated through the booking system or another agreed method.

4. Provider cancellation and refund policy

Each pet-care provider may maintain a cancellation and refund policy appropriate to that provider's schedule and services. The applicable policy is displayed or linked during the booking process and is incorporated into these Terms for that booking.

The policy associated with your confirmed booking governs customer cancellation deadlines, cancellation charges, credits, and refund eligibility for that booking. A later change to a provider's policy does not retroactively alter an already confirmed booking.

If these Terms and the applicable provider policy conflict, the provider policy controls only for cancellations, cancellation charges, credits, and refunds. These Terms control in all other respects.

Approved refunds are ordinarily returned to the original payment method when practicable. The time needed for a refund to appear may depend on the payment processor and your financial institution.

5. Changes and provider cancellations

Requested booking changes are subject to provider availability and may change the price. If we or the assigned provider must cancel a confirmed service, we will notify you as reasonably practicable and address prepaid amounts for the unperformed service. We are not responsible for delays or failures caused by severe weather, unsafe conditions, emergencies, government actions, utility or communications failures, or other circumstances outside reasonable control.

6. Home access and service conditions

You are responsible for providing timely, accurate, and lawful access instructions. You must disclose alarms, cameras, locks, other persons expected at the property, and conditions that could affect safe service. If access is unavailable or conditions are unsafe, the provider may be unable to complete the service and the booking may be treated according to the applicable cancellation policy.

You authorize the assigned provider to enter the property at the agreed times and to perform the confirmed services. Keys, codes, and access information will be handled as described in the booking arrangements and our Privacy Notice.

7. Pet information, behavior, and safety

You agree to disclose accurate information about each pet's health, medications, routines, vaccination status, escape risks, bite or aggression history, triggers, and interactions with people and animals. You must provide suitable food, supplies, identification, restraints, and any required medication instructions.

We may decline, modify, or stop a service when information was omitted or when a pet, person, property condition, or environment presents an unexpected safety risk. We will make reasonable efforts to notify you or your emergency contact when circumstances permit.

8. Veterinary and emergency care

You authorize us and the assigned provider to contact your veterinarian, emergency contact, or an emergency veterinary facility when reasonably believed necessary to protect an animal's health or safety. When you or your emergency contact cannot be reached, you authorize reasonable emergency action based on the information available.

You remain responsible for veterinary treatment, transportation, medications, and related third-party costs, except to the extent those costs result from liability that cannot lawfully be excluded or limited.

9. Service reports and photographs

Providers may create visit notes, service reports, and photographs to document care and communicate with you. These materials may be stored in your account and handled according to our Privacy Notice. We will not use private in-home photographs for public advertising without permission.

10. Communications

You consent to receive service-related emails, account notices, and messages needed to administer bookings, safety matters, payments, and reports. You are responsible for keeping your contact information current. Service communications are not promotional subscriptions and may be necessary to provide requested services.

11. Acceptable use

You may not misuse the website, attempt unauthorized access, interfere with security or operation, upload unlawful or harmful material, impersonate another person, or use customer, provider, or site information for an unauthorized purpose.

12. Disclaimer and limitation of liability

We will provide services with reasonable care consistent with the confirmed booking. However, animals and home environments can be unpredictable, and we cannot guarantee that every illness, injury, escape, property problem, or other event can be prevented.

To the fullest extent permitted by law, OhmBrew LLC and its owners, personnel, and service providers will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the website or services. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. Suspension or termination

We may restrict or terminate an account or decline future services for nonpayment, unsafe conditions, material misrepresentation, abusive conduct, repeated policy violations, unlawful activity, or threats to people, animals, property, or the service. Existing payment and recordkeeping obligations survive termination.

14. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute will be brought in a court with jurisdiction in Colorado unless applicable law requires otherwise.

15. Changes to these Terms

We may update these Terms from time to time. The revised Terms will be posted with a new effective date. Material changes apply prospectively unless you expressly agree otherwise. A confirmed booking remains governed by the Terms and provider policy accepted for that booking.

16. Entire agreement and severability

These Terms, the applicable provider cancellation and refund policy, the confirmed booking details, and the Privacy Notice form the agreement concerning the service. If a provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law.
